Evidence Exchange, a leading provider of E-Discovery Consulting and E-Discovery Processing Services, announced its recent certification with the Safe Harbor Program of the US Department of Commerce. By registering on March 19, 2008 as being “Safe Harbor” compliant, Evidence Exchange has acknowledged its understanding and compliance with The European Commission’s Directive on Data Protection. The Safe Harbor Program enables U.S. companies to meet European requirements for data privacy protection. Participation in the Program should streamline data transfers because it ensures that data can be lawfully transferred from collection sites in the European Union to Evidence Exchange in the United States for “best of breed” E-Discovery Processing. Previously, such assurances related to European data privacy concerns had been addressed by Evidence Exchange in individual engagement letters. By registering the entire company in Safe Harbor, our clients will no longer need to address this privacy concern at the contract level.More...

Drawing upon over 20 years of E-Discovery experience, the authors share their observations on the “New World Order”, including the importance of preservation, process and case management. George Paul and Bruce Nearon, the authors of The Discovery Revolution, asked Michael Prounis, the CEO / CoFounder of Evidence Exchange to write a review of their blockbuster book, The Discovery Revolution, for use in connection with the book's advertising appearing on the ABA website. This book focuses on the e-discovery amendments to the Federal Rules of Civil Procedure, which were approved by the Judicial Conference of the United States on September 20, 2005. The issues addressed by the new rules will significantly impact the way law is practiced and are discussed in detail in the book. PROUNIS TESTIFIES BEFORE US COURT'S RULEMAKING BODY

On February 11, 2005 Michael Prounis and fellow Digital Evidence Project Survey members testified in Washington D.C. before the Committee on Rules of Practice and Procedure. The committee convened the public hearing to gather testimony concerning the proposed changes to the Federal Rules of Civil Procedure from digital discovery experts and industry leaders. The Digital Evidence Project Survey Subcommittee was invited to share the results of their January survey, which queried corporate counsel on the proposed amendments. Commenting on his testimony, Prounis noted: “We were looking to gain an untapped perspective and judge the real needs of our clients. This study certainly accomplished that goal, and we were very excited to present our findings to the committee.” More...

SURVEY SHOWS CORPORATE COUNSEL SUPPORTIVE OF DIGITAL DISCOVERY AMENDMENTS

The American Bar Association Section of Science & Technology Law published findings this month from its Digital Evidence Project Survey. The survey found that the vast majority of corporate counsel agreed that the Federal Rules of Civil Procedure (FRCP) needed to address the new demands of electronic discovery.
