PROUNIS TESTIFIES BEFORE US COURT'S RULEMAKING BODY

(New York, NY) - February 14, 2005: On February 11, 2005 Michael Prounis and fellow Digital Evidence Project Survey members testified in Washington D.C. before the Committee on Rules of Practice and Procedure. The committee convened the public hearing to gather testimony concerning the proposed changes to the Federal Rules of Civil Procedure from digital discovery experts and industry leaders. The Digital Evidence Project Survey Subcommittee was invited to share the results of their January survey, which queried corporate counsel on the proposed amendments. Commenting on his testimony, Prounis noted: “We were looking to gain an untapped perspective and judge the real needs of our clients. This study certainly accomplished that goal, and we were very excited to present our findings to the committee.”

The hearing concluded the six-month public comment period concerning proposed FRCP amendments. The amendments under discussion address discovery procedures as they relate to electronically stored information. Concluding four days’ testimony, in three cities, by over two hundred witnesses, the Washington, D.C. session was the third and final public hearing sponsored by the committee.

The committee included such influential authors of digital evidence case law as the Honorable Lee Rosenthal, the Honorable Nathan Hecht, the Honorable David Levi, and the Honorable Shira Scheindlin, among others. The committee will now take the hearing’s testimony under advisement before determining whether or not it should submit the amendments for full approval in June.
